NOTICE OF SETTLEMENT



All individuals currently or formerly employed by Five Point and Mecca Restaurants and David Meinert in the State of Washington and paid on an hourly basis between April 5, 2019, through April 5, 2022.

A former employee (“Plaintiff”) brought claims against Wide Open, Inc., Queen Anne Diner LLC, and David Meinert (collectively “Five Point and Mecca Restaurants and David Meinert”) alleging that Five Point and Mecca Restaurants and David Meinert (1) failed to provide compliant meal periods under Washington law and (2) failed to provide compliant rest breaks under Washington law and (3) failed to pay overtime wages and minimum wages. Five Point and Mecca Restaurants and David Meinert strongly deny these claims. The parties have reached a proposed Class Action Settlement.

Five Point and Mecca Restaurants and David Meinert strongly deny any fault, wrongdoing, or liability. If the Parties had not reached a Settlement, Five Point and Mecca Restaurants and David Meinert would have continued to vigorously defend against Plaintiff’s claims, including seeking a denial of class certification and a full defense verdict at trial. Five Point and Mecca Restaurants and David Meinert agreed to this Settlement to avoid the risk, burden, and expense of further litigation, and as a means of making its employees whole for even any arguable claims relating to the lawsuit.

The Class Action Settlement includes a total maximum settlement payment by Five Point and Mecca Restaurants and David Meinert of $325,000.00.

To qualify for a share of this payment, you must have worked for Five Point and Mecca Restaurants and David Meinert in a position paid on an hourly basis at any time from April 5, 2019, through April 5, 2022, submit a valid, timely claim, and have not excluded yourself from the Class Action Settlement.

SIGN A CLAIM FORM The only way to get a payment is from this settlement fund. To submit a valid, timely claim, a Settlement Class Member must (i) provide complete and accurate information on the Claim Form in writing, online at www.queenannedinersettlement.com, or via email; (ii) verify his or her identity by providing a copy of a current government-issued photo identification, such as a driver’s license or passport; (iii) provide a current IRS Form W-9; and (iv) provide the required information by the deadline.
ASK TO BE EXCLUDED Get no payment. Give up rights relating to the legal claims in this Case.
OBJECT If you do not ask to be excluded, you may write to the Court if you do not like the settlement and explain why. If the Settlement is approved, you will still receive a payment, if you submitted a valid, timely claim form, and you will give up rights relating to the legal claims in this Case.
GO TO A HEARING If you do not ask to be excluded, you may ask to speak in Court about the fairness of the Class Action Settlement.
